Association meeting May 11th - "The European Commission's acquisition control - the current development"

Many thanks to Stefan Brandt and Baker & McKenzie for the nice arrangements on the association meeting on May 11th. 35 members could listen to a lecture by Peter Ohrlander from GD Competition, who spoke of "the European Commission's acquisition control - the current development". Afterwards Baker & McKenzie offered a lovely buffet and refreshing beverages.

Peter Ohrlander from GD Competition speaks of "The European Commission's acquisition control - the current development". Peter is a Policy Analyst at the Directorate A /2 and is responsible for policy issues in the EU acquisition control. Peter explains the current developments in the European Commission's acquisition control and gives us a look behind the scenes at GD Competition, for a better understanding of how they work with acquisition cases and other matters related to competition law.

Topic for discussion: “Has the Unfair Commercial Practices Directive changed Swedish case law?”

From the program: The chairman of the association, Ulf Bernitz, along with the panelists Christer Fallenius och Ylva Aversten (both from the Swedish Market Court) and Carl Anders Svensson (the lawfirm Advokatirman för Marknadsrätt) will based on resent settled cases analyze and illustrate the development of the law.

The chairman of the association Ulf Bernitz opens with a reflection over the relationship between the unfair commercial practices directive and the market practices legislation. Bernitz questions whether the ruling of the ECJ in C-304/08, Plus Warendal, means that the Swedish prohibition on advertising lotteries has become null and void? He also analyzes the ruling of the ECJ in C-487/07 regarding exploitation of goodwill. Furthermore, the panel describes amongst other things, the Market Court’s judgments MD 2009:40 and MD 200:33 (the principle of lawlessness in relation to the Market Practices Act) and MD 2009:29 (limitations in means of communication).


Association meeting 26 May 2010 at Pressklubben, Vasagatan

Topic of discussion: “New possibilities for product placement through new radio- and TV legislation”

From the program: The association for Market Legislation welcomes the members to a meeting regarding the new radio- and TV Act that is proposed to enter into force 1 August 2010. The Governmental Bill means according to the Government “clearer advertising rules and a greater freedom of choice for the companies in the placement of commercial breaks and sponsor messages, provided that it does not harm the integrity and value of the show”. A new feature is the specific rule on product placement that during orderly forms makes the use of product placement possible. The legislation also changes the authorities’ present organization through the merger of the Radio and TV Authority and the Control Organisation for Radio and TV.

Rosemarie Jansson Håvik, legal advisor at the Ministry of Culture, and Filippa Arvas Olsson, deputy director at the Ministry of Culture, presents the Government’s Legislative Bill regarding the newRradio- and TV Act and describes the news in the legislation. Attorney Tomas Lindqvist and Associate Andréas Joersjö, Hammarskiöld & Co describes the practical consequences of the new rules for product placement and discusses whether the Governmental Bill clarifies the scope for product placement as well as a liberalization of the rules in the area.

Topic of discussion: Which, if any, agreements or information exchanges about prices should be prohibited in vertical relationships? and To what extent should IP Rights (Trademark, Copyright, Design Rights, and Appellation d‘Origine) restrict comparative advertising?

From the program: Attorney Elisabeth Eklund, Advokatfirman Delphi (international reporter) will speak particularly on the subject of the development of resale price maintenance since Leegin, the possibilites of exceptions according to the Commission’s new Vertical Guidelines and “hub-and-spoke arrangements”; Robert Moldén, case officer at the Competition Authority/post graduate candidate at the University of Lund, will describe Swedish case-law, and Fredrik Hägglund, General Counsel, ICA-handlarnas förening , participates in the panel discussion.
